Overview

Welcome to ProQ BBQs & Smokers. The terms “we”, “us” and “our” refer to ProQ Barbecues & Smokers Ltd. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are powered by Shopify.

These Terms of Service (the “Terms”) together with any policies referenced herein describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Section 1 - Eligibility and Accounts

By agreeing to these Terms you confirm you are at least 18 years old. If you allow minors to use the Services on devices you own or manage you are responsible for their use.

To use the Services you may be asked to provide information such as email, billing, payment and shipping details. You must provide accurate, up‑to‑date information. You are responsible for maintaining account credential security and all activity on your account. Accounts are not transferable.

Section 2 - Our Products

We make reasonable efforts to represent product images and descriptions accurately, but colours and appearance may vary by device and settings. Product descriptions and availability may be changed at any time without prior notice. We reserve the right to limit quantities or discontinue products.

Section 3 - Orders and Contract Formation

Placing an order is an offer to purchase. We may accept or decline orders at our discretion. A contract between you and ProQ Barbecues & Smokers Ltd is formed only when we send an order confirmation by email. We must receive and process payment before accepting an order.

If we cancel or change an order we will try to notify you at the contact details provided. Cancellation rights for consumers are set out in Section 6 below. You warrant that purchases are for personal or household use, not for resale or export.

Section 4 - Prices, Taxes and Payment

Product prices, promotions and discounts may change. The price charged is the price shown at checkout when you place your order. Unless stated otherwise, prices exclude taxes, customs, import duties and shipping charges, which you are responsible for paying where applicable.

If you are a business purchasing from us, VAT treatment will be shown at checkout. All payments must be made using the methods displayed at checkout. You represent that the payment instrument you supply is yours and that payment details are accurate.

Section 5 - Shipping, Title and Risk

Delivery times shown on the Site or at checkout are estimates only. We are not liable for carrier delays, customs clearance delays, force majeure events or other events outside our reasonable control. None of this affects your statutory rights as a consumer.

All goods remain the sole property of ProQ Barbecues & Smokers Ltd until we have received payment in full of all amounts due in respect of those goods. Title in goods transfers to you only when full payment has been received by us. If we are unable to fulfil an order because of insufficient stock, we may cancel the order and will refund you the full amount paid for that order.

Section 6 - Refunds, Returns and Faulty, Lost or Damaged Goods

6.1 How to contact us about returns and refunds

Before returning any product please contact us by phone on 0345 340 4845 or by email here with your order number and a description of the issue. We will provide return instructions and, where applicable, a returns reference.

6.2 Damaged in transit

If goods arrive damaged we will, at our option, replace, repair or refund the goods. Contact us promptly and preserve the packaging and damaged item where possible. For larger items we may arrange a courier collection or issue a prepaid shipping label; you may be asked to drop the parcel at a carrier drop‑off location. We will reimburse reasonable return postage costs on receipt of a valid receipt. Additional delivery costs for replacements will be free of charge where applicable.

6.3 Lost in transit

If you do not receive all items in your order, notify us within 7 days of the date of your order so we can investigate with our courier. We cannot accept claims for lost goods reported outside this 7‑day period. If the courier confirms loss we will either resend the missing goods or refund you at our discretion.

6.4 Faulty goods

If a product is faulty we will, where appropriate, replace, repair or refund the item in accordance with your statutory rights. Contact us for return instructions. Please keep original packaging where possible. Postage costs for returning faulty goods will be reimbursed by us on receipt of proof of postage.

6.5 Christmas returns

For purchases made between 15 November and 24 December we offer an extended returns window. Items bought during that period can be returned until 31 January following the purchase year, subject to the product being returned in the condition required by these Terms.

6.6 General returns (change of mind)

If you change your mind you may return most items within 30 days of receipt. Before returning goods contact us for return instructions and a returns reference. Unless the goods are faulty, return postage costs are your responsibility. Items must be returned in 'as‑new' condition (unused, undamaged, and in original packaging where possible). Refunds for returned items will be issued for the purchase price less any original delivery fees once we have inspected and confirmed the item's condition. If we cannot verify that the product was purchased from ProQ we may refuse the return.

Section 7 - Your Right to Cancel (Distance Contracts)

If you are a consumer purchasing at a distance you may have a statutory right to cancel your order. To exercise your right to cancel you must notify us in writing by email here within 14 days of placing your order (or, where applicable, within 14 days of receipt for some contracts). As a condition of cancellation you must return the goods at your expense in a saleable condition to the address we provide. Goods are deemed returned when received by us.

Where cancellation is valid and the goods are returned in saleable condition we will refund the purchase price. If the goods are not in a saleable condition we may reduce the refund to reflect diminished value, up to the full value of the purchase if the goods are unsaleable.

Section 8 - Refunds policy (summary)

Damaged, lost in transit, and faulty goods are handled per Sections 6.2–6.4. Proof of age may be required before dispatch of certain prizes or returns. Any reimbursements for postage require valid receipts.

Section 9 - Competitions

From time to time we may run competitions, prize draws or giveaways (“Competitions”). By entering a Competition you agree to be bound by these Terms and any additional rules published for that Competition.

  • Eligibility: To enter you must be at least 18 years old and a resident of the United States, Canada, a member state of the European Union, or the United Kingdom, unless the Competition rules state otherwise.
  • How to enter: Follow the entry instructions and any additional terms published on our social media, email, website, print materials or other entry channels. You must enter before the date and time specified in the Competition rules.
  • Entry limits: Only one valid entry per person unless the specific Competition rules state differently. Multiple entries from the same person will be disqualified. No responsibility is taken by us for entries not received.
  • Selection and notification: Winners will be selected at random from valid entries unless the Competition rules specify otherwise. We will attempt to notify the winner by the method specified in the Competition rules (for example, by email, phone or social media) by the date stated in the Competition rules.
  • Prize delivery: The winner will receive their prize by courier within 14 days of the announcement unless otherwise specified. Proof of age may be required before dispatch of the prize.
  • Right to cancel: We reserve the right to cancel, modify or withdraw any Competition at any time for any reason.

Section 10 - Voucher and Discount Terms

These voucher and discount terms apply in addition to any specific terms displayed with a voucher, offer or promotion. Vouchers and discounts are subject to availability and may be withdrawn, amended or cancelled at any time.

  • Activation and use: Vouchers are redeemed by entering the correct voucher code at checkout on the ProQ Barbecues & Smokers website. Follow the instructions shown on the voucher or promotion. E‑Vouchers and codes must be entered exactly as provided.
  • Validity period: Each voucher will display a valid‑from date and expiry date. Vouchers cannot be used before the valid‑from date or after the expiry date and will be automatically invalid on expiry.
  • Scope and exclusions: Vouchers apply only to purchases on proqsmokers.co.uk unless the voucher expressly states otherwise. Vouchers cannot be applied to past orders, cannot be backdated and cannot be redeemed for cash.
  • Combination and stock limits: Unless the voucher states otherwise, vouchers cannot be combined with other vouchers or offers. Some vouchers relate to limited stock promotions; if promotional stock is exhausted the voucher may become invalid even if the voucher expiry date has not passed.
  • One‑time use and household limits: Unless expressly stated, each voucher type may be used only once per customer. If multiple customers are registered at the same delivery address, a voucher type may only be used by one customer at that address.
  • Account and transfer restrictions: You may only use a voucher assigned to you. You must not transfer, sell or share voucher codes for use on other accounts. Using duplicate or false customer details to redeem vouchers is prohibited and may result in cancellation of the order and refusal of future offers.
  • Fraud and termination: We reserve the right to refuse or cancel the use of a voucher where we suspect fraud or breach of these terms. We may withdraw vouchers or offers at any time; withdrawn vouchers cannot be used on orders placed after the withdrawal date.
  • Regional restrictions: We may limit the applicability of particular vouchers or offers to specific regions or territories. Different offers may be available to different customers at the same time.

Section 11 - Intellectual Property

All content on the Services (text, images, designs, logos, product descriptions, videos, audio and the selection and arrangement of content) is owned by ProQ Barbecues & Smokers Ltd, its licensors or affiliates and is protected by applicable intellectual property laws. You may use the Services for personal, non‑commercial use only. Any unauthorised use may violate copyright, trademark, and other laws.

Section 12 - Optional Third‑Party Tools

The Services may provide access to third‑party tools, integrations, widgets or services (“Optional Tools”). We do not control or endorse third parties and provide Optional Tools “as is”. You use Optional Tools at your own risk and should review applicable third‑party terms and privacy notices before use.

Section 13 - Links to Third‑Party Sites

The Services may link to third‑party websites. We are not responsible for their content, accuracy or practices. If you access third‑party sites you do so at your own risk and should review their terms and privacy policies. Complaints about third‑party products or services should be directed to that third party.

Section 14 - Relationship with Shopify

ProQ Barbecues & Smokers Ltd uses Shopify to operate our online store. Any sales you make are with ProQ Barbecues & Smokers Ltd. Shopify provides the platform but is not a party to the contract between you and us and does not assume liability for the goods sold.

Section 15 - Privacy and Data Protection (UK)

Personal data we collect is handled in accordance with our Privacy Policy. We process personal data to provide and improve the Services, to complete orders and to communicate with you. Where we act as a data controller, we process data under UK data protection law (including the UK GDPR and the Data Protection Act 2018). You have rights to access, correct, restrict processing, object, request erasure, and data portability where applicable. Section 16 - Feedback and Reviews

If you provide Feedback (ideas, suggestions, reviews, proposals) you grant ProQ Barbecues & Smokers Ltd a perpetual, worldwide, transferable, royalty‑free licence to use, reproduce, adapt, publish and display that content for any purpose including marketing and social media.

You may request anonymisation of a review by contacting our DPO, and we will consider such requests in accordance with applicable data protection law.

Section 17 - Errors, Inaccuracies and Omissions

We try to keep the Services up to date but errors can occur. We may correct errors, update information and cancel orders as necessary. We will notify you of any material corrections affecting your order.

Section 18 - Prohibited Uses

You must use the Services lawfully. Prohibited uses include: (a) illegal or harmful purposes; (b) infringing third‑party rights; (c) sending unsolicited advertising or spam; (d) uploading malware or other harmful content; (e) scraping, data‑mining or otherwise extracting site content without permission; and (f) interfering with site security. We may suspend or terminate accounts for prohibited activity.

Section 19 - Termination

We may suspend or terminate your access to the Services in our discretion and without notice. You remain liable for amounts due up to termination. Sections that by nature survive termination will continue to apply (for example, Intellectual Property, Indemnity, Limitation of Liability).

Section 20 - Disclaimers

The Services and all products are provided “as is” and “as available” except as expressly stated. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied. For UK consumers certain statutory rights cannot be excluded; nothing in these Terms affects those rights.

Section 21 - Limitation of Liability

To the maximum extent permitted by law, ProQ Barbecues & Smokers Ltd and its affiliates will not be liable for indirect, incidental, special or consequential losses. For consumers in the UK, nothing in these Terms will limit your statutory rights under applicable consumer protection legislation where those rights cannot be limited.

Section 22 - Indemnity

You agree to indemnify and hold harmless ProQ Barbecues & Smokers Ltd, Shopify and our affiliates from any claims, losses, liabilities, damages and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your use of the Services.

Section 23 - Severability

If a court finds any provision of these Terms invalid or unenforceable, that provision will be modified or severed to the minimum extent required and the remainder of the Terms will continue in full force.

Section 24 - Waiver and Entire Agreement

Failure to enforce any right or provision does not constitute a waiver. These Terms and the policies referenced herein are the entire agreement between you and ProQ Barbecues & Smokers Ltd concerning the Services, superseding prior agreements.

Section 25 - Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without consent.

Section 26 - Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them (including non‑contractual disputes) are governed by the laws of England and Wales. If you are resident in the UK you may bring proceedings in the courts of England and Wales, or in your local courts where required by law. If you live outside the UK, you and we submit to the non‑exclusive jurisdiction of the courts of England and Wales.

Section 27 - Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in accordance with applicable law. The latest Terms are available on this page. Continued use after changes constitute acceptance.

Section 28 - Complaints and Dispute Resolution

If you have a complaint please contact us at info@proqsmokers.com. For UK consumers, if we cannot resolve your complaint you may be entitled to use an alternative dispute resolution (ADR) service. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO); see https://ico.org.uk.
